This Exhibition Agreement (The Agreement) is made between The Guild of Artists & Artisans (The Guild), the Artist, and the Venue.
Delivering + Picking Up Artwork
The Artist is responsible for delivering artwork to and from the venue at the agreed upon dates and times. All artwork must be ready for presentation upon delivery. Delivered work must be dry and complete.
The Artist is responsible for picking up unsold artwork from the Venue on the designated pick-up date and time. Artwork will only be released to someone other than the artist if prior arrangements have been made. If an arrangement has not been made and the artwork has not been picked up 30 days after the exhibition ends, the artwork will become property of The Guild, and The Guild reserves the right to treat the artwork as a donation.
If necessary, all shipping and packing costs of unsold artwork will be the responsibility of the Artist. The Artist is responsible for coordinating transportation of unsold artwork.
Sales
Any work sold in the exhibition will result in the artist members receiving 70% of the sale price, with The Guild keeping the remaining 30%. Non-members will receive 60% of the sale price, with The Guild keeping the remaining 40%. The Guild will charge tax at the time of the sale and remit this as required by law. The Artist will receive payment for sold work(s) at the end of each month.
The Venue agrees to only release artwork to a customer if the customer provides proof of purchase by showing a receipt of payment. Upon showing proof of purchase, the customer may take the artwork home with them.
If artwork needs to be shipped to a customer during the exhibition dates, The Guild will coordinate shipping.
Promotion
The Artist and the Venue understand that The Guild does extensive promotion on traditional and social media. The Guild, the Artist, and the Venue may publish photographs of artwork for promotional purposes.
Care and Preservation of Artwork
The Guild and the Venue agree to professionally care for all artwork and to report any damage or other findings to the Artist. The Guild is not responsible for cleaning, restoring, or reframing the artwork. The Guild is not responsible for any damage to the artwork during the exhibition time frame, and The Guild recommends that the Artist and the Venue provide their own insurance.
Liability & Insurance
In displaying artwork at the Venue, The Guild is acting solely as a representative of the Artist, and neither it nor its members shall be liable for loss or damage to artwork due to fire, theft, loss or destruction of any kind other than those created by The Guild’s negligence. The Guild recommends that all parties have their own proper insurance coverage.
